This privacy policy (the “Privacy Policy”) is intended to inform you of policies and practices of Bracket Labs, LLC d/b/a TaskRay ( “us” or “we” or "TaskRay") regarding the collection, use and disclosure of the information we collect from you through your interaction with us, including through our website at taskray.com and any mobile or web-based application and also in relation information we may receive submitted by you to our partners and resellers, through our contractual relationship with them.

We put great efforts in making sure that we secure the personally identifiable information related to you (“Personal Information”) and use it properly. This Privacy Policy will tell you how we use and protect Personal Information. 

This Privacy Policy is an integral part of any agreement entered into between you (or the entity that you are acting on behalf) and us

User Consent

By submitting information to us, you agree to the terms of this Privacy Policy and you expressly consent to the processing of the information provided by you according to this Privacy Policy. Personal Information may be processed by us in the country where it was collected as well as in other countries (including the United States) where laws regarding processing of information may be less stringent than the laws in your country

Personal Information You Provide to Us

We collect information that you submit to us voluntarily:

  • When you enter any information into any forms on the TaskRay website, we will collect such information. Examples of information you may, at your option, provide us include your name, email address, and phone number.
  • When you leave us feedback or request support, we will collect any information that is contained in your feedback or support request. If you exchange any messages or post any content on our website, we will collect that information as well.
  • When you contact us by sending us an e-mail, we will collect your e-mail address and any information contained in the e-mail you send us.
  • When you purchase products or services from us, we will collect the information necessary to complete a business transaction, including your credit card number or other payment information.

  • When you participate in a survey or promotion we offer, we will collect any entry information, including your name and email. If you participate in a survey we will also collect your survey responses.
  • Without derogating from any other provision under this Privacy Policy, when you enter into any contractual relations with one of our business partners that specifically refers you to our services, we receive the information submitted by you to such business partner via email and we may then provide such information to Salesforce. Examples of information submitted by you to such business partner that we may receive via email include your name, email address, and phone number.

Personal Information Collected Via Technology

As you navigate our website, we will collect certain information automatically, including your Internet protocol address, browser type, and operating system. We also use Cookies and navigational data like Uniform Resource Locators (URLs) to gather information regarding the date and time of your visit and the information for which you searched and viewed. This type of information is collected to better understand how you use our website and to make it more useful to you.
An “Internet protocol address” or “IP Address” is a number that is automatically assigned to your computer when you use the Internet. In some cases, your IP Address stays the same from browser session to browser session; but if you use a consumer internet access provider, your IP Address probably varies from session to session. We track IP Addresses solely in conjunction with session cookies to analyze our web page flow.

“Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on the Site. Persistent Cookies can be removed by following Internet browser help file directions. If you choose to disable Cookies, some areas of the Site may not work properly.

We do not respond to browser-based “do not track” signals. Currently we do not have any third party sites who push content to our site.

We use Google Analytics and other third party analytics on our website. Google Analytics is a web analytics service provided by Google. Google Analytics and other third parties use cookies to collect anonymous traffic data to help use analyze how users use the website. The information generated by a cookie about your use of the website (including your IP address) will be transmitted to and stored by Google or other third parties on servers in the United States. Google and other third parties will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for us and providing other services relating to website activity and internet usage. Google and other third parties may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Personal Information We Receive From Other Sources

We may receive information about you from other sources like telephone or fax. We may add this information to the information we have already collected from you via our interaction.
We may receive information about you from third parties, including third party advertising and affiliate marketing companies, or third parties who help us administer surveys and promotions. We may combine this information with information we collect about you on our website.
As noted, we may also receive information about you from Salesforce.com or one of our business partners in order to provide you our services. Our provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents. When you click on such a link, you will leave our website and go to another website. During this process, another entity may collect information from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites.

Use of Personal Information

In general, information you submit to us is used by us to provide products and services to you, respond to requests that you make, and to improve our product offering, develop and test new products and offerings, and to offer you additional information, opportunities, and functionality. We may also use the information you submit to us to provide you with electronic newsletters or promotional e-mails. We also use this information in connection with any surveys you complete or promotions you may enter. We may also send you marketing and promotional information about our third-party partners, should you request to receive such communications from us.

We may create anonymous information records from information by excluding information (such as your name) that makes the information personally identifiable to you. This anonymous information may be related to demographics, usage patterns, or other information collected in connection with your use of the service. We may use this anonymous information for our business purposes, including to analyze usage patterns so that we may enhance our product offerings. We reserve the right to use, share, and disclose Anonymous Information to third parties in our discretion.

We will process, use, retain and share Personal Information solely for the purposes described in this Privacy Policy and only when reasonably necessary and proportionate to achieve such purposes for which such information was collected and processed.
To the extent relevant and possible, we will make efforts to maintain Personal Information accurate, complete and up to date

If you provide feedback to us (which includes any survey responses), we may use and disclose such feedback for any purpose, provided we will not associate such feedback with the information submitted to us.

Disclosure of Information

Except as otherwise stated in this Privacy Policy, we do not trade, rent, or share Personal Information with third parties, unless you ask or authorize us to do so.

However, like many companies, we use a number of service providers to help us provide our products and services. Whilst these services will require Personal Information related to you to be disclosed, we only allow these service providers to use it as necessary to fulfill the purposes for collecting the Personal Information under this Privacy Policy and under strict conditions.

However, these service providers do not have any independent right to use or share this information (except pursuant to a legal requirement such as a subpoena or warrant). We may share information with our third party service providers in connection with any surveys or promotions they may help us administer.

Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under common control (collectively, “Affiliates”), we may in the future. We may share some or all of the information provided by you with these Affiliates, in which case we will require our Affiliates to honor this Privacy Policy.

If our company or our assets related to our services are acquired by another company, that company will possess the information collected by us and it will assume the rights and obligations regarding information submitted by you as described in this Privacy Policy.

We may disclose information submitted by you if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on us; or (b) to protect or defend the rights, property, or safety of TaskRay or any third party.

Without derogating from the above, we may share the information submitted by you with Salesforce.com or one of our business partners in order to provide you with our services.

Additionally, a merger, acquisition or any other structural change will require us to transfer the Personal Information submitted by you to another entity, as part of the structural change, provided that the receiving entity will comply with this Privacy Policy

Your Choices Regarding Personal Information

We offer you choices regarding the collection, use and sharing of the information submitted by you. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly (please see contact information below).

Despite your indicated e-mail preferences, we may send you administrative e-mails regarding our product offerings or notices of any updates to our Privacy Policy.

Changes to Information, Retention and Destruction

We retain different types of Personal Information for different periods, depending on the purposes for processing such information, our legitimate business purposes as well as pursuant to legal requirements under the applicable laws.
We will maintain your contact details, to help us stay in contact with you. At any time before or after the termination of our services, you can contact our team and request to delete your contact details.

Note that we may retain your details without using them unless necessary and for the necessary period of time, for legal requirements and proceedings, and that we will not retain the Personal Information related to you for any longer than reasonably necessary for purposes described in this Privacy Policy.

You may change any of the information submitted by you in your account by sending an e-mail to us at the e-mail address set forth below. You may request deletion of information submitted by you by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements).

We will keep aggregated non-identifiable information without limitation, and to the extent reasonable we will delete or de-identify potentially identifiable Personal Information, when we no longer need to process the information.
In any case, as long as you use our services, we will keep information about you, unless applicable law requires us to delete it

Dispute Resolution

If you believe that we have not adhered to this Statement, please contact us by e-mail at the address below. We will do our best to address your concerns. If you feel that your complaint has been addressed incompletely, we invite you to let us know for further investigation. If we are unable to reach a resolution to the dispute, we will settle the dispute exclusively as set forth under any license agreement signed between you and TaskRay

Security

We understand the importance of the Personal Information. We use reasonable measures to maintain the security of the information submitted by you and provide full transparency of how we do this. These measures provide industry standard security. Despite these measures, you should know that no company, including us, can fully eliminate security risks associated with information, including, but not limited to, cyber-attacks, malicious activities, malfunctions, honest mistakes or other types of abuse and misuse.

Data Privacy Framework Notice

TaskRay complies with the principles of the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce and relies on the European Commission’s adequacy decision for the EU-U.S. DPF to receive Personal Information transfers from the European Economic Area. TaskRay has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of Personal Information received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. TaskRay has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles with regard to the processing of Personal Information received from Switzerland in reliance on the Swiss-U.S. DPF (together with the EU-U.S. DPF Principles, the “DPF Principles”). If there is any conflict between the terms in this Policy and the DPF Principles, the DPF Principles shall govern. Under the DPF Principles we are responsible for the processing of Personal Information we receive and, subsequently, for the Personal Information that we then transfer to a third-party service provider, if the Personal Information is processed in a manner inconsistent with the Data Privacy Framework.

If you have any questions, concerns, or complaints about our compliance with the DPF Principles, we encourage you to contact us under the contact details set forth in the section titled “Additional Information and Contact Details” below.
We commit to refer unresolved complaints regarding our handling of Personal Information we received in reliance on the EU-US DPF and the UK Extension to the EU-US DPF; and the Swiss-US DPF to JAMS DPF Program an alternative dispute resolution provider based in the United States, the European Union, the United Kingdom, and/or Switzerland (as applicable). If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information or to file a complaint. JAMS DPF Program’s services are provided at no cost to you.

Finally, if you have a complaint that we have violated the DPF Principles that has not been resolved by other means, you may have the ability to invoke binding arbitration as outlined more fully on the Data Privacy Framework website.
TaskRay is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC).

Specific provision for residents of the European Economic Area, the United Kingdom and Switzerland

The General Data Protection Regulation (“GDPR”), the UK General Data Protection Regulation (“UK GDPR”) and the Swiss Federal Act on Data Protection (“FADP”) provide residents of the EEA, the United Kingdom (UK) and Switzerland specific rights regarding their Personal Information. If the GDPR, the UK GDPR or the FADP applies to the processing of Personal Information related to you by us, then the terms listed in this section apply, in addition to your rights under this Privacy Policy.

We base our processing of Personal Information as a Data Controller on the following lawful grounds:

  • All processing of Personal Information related to you which are not based on the lawful grounds indicated below, are based on your consent, whether to us or to third parties.
  • We process Personal Information submitted by you as a preliminary necessary step in connection with our agreement with our various business partners.
  • We will process Personal Information related to you to comply with a legal and contractual obligation and to protect yours and others' vital interests.
  • We will rely on our legitimate interests, which we believe are not overridden by your fundamental rights and freedoms, for the following purposes:
    • Communications with you, including direct marketing, or where you make contact with us through our website and other digital assets; and Support, customer relations, our services operations.

At any time, you can contact our team as noted below and request to exercise your rights in accordance with the provisions provided by law:

  • You are entitled to access the Personal Information that we keep about you together with information about how and on what basis the Personal Information is being processed and to rectify when such information is inaccurate. If you find that the Personal Information related to you is not accurate, complete or updated, then please provide us with the necessary information to correct it.
  • You can contact us if you want to withdraw your consent to the processing of Personal Information related to you, where applicable. Exercising this right will not affect the lawfulness of processing based on consent before its withdrawal.
  • You are entitled to request to delete or restrict access to Personal Information related to you in limited circumstances as described under the GDPR, the UK GDPR or the FADP, subject to certain exceptions. If we need to delete Personal Information related to you following your request, it can take time until we completely delete residual copies of Personal Information related to you from our active servers and from our backup systems.

If you exercise one (or more) of the above-mentioned rights, in accordance with the provisions under the GDPR, the UK GDPR or the FADP, you are entitled to request to be informed that third parties that hold Personal Information related to you, in accordance with this Privacy Policy, will act accordingly.

You are entitled to request the transfer of Personal Information related to you in accordance with your right to data portability.

  • You are entitled to object to the processing of Personal Information related to you, for example in relation to direct marketing.
  • You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affecting you.
  • You have the right to obtain a copy of or access to safeguards under which Personal Information related to you is transferred outside of the EEA, the UK or Switzerland, respectively.
  • You have a right to lodge a complaint with a data protection supervisory authority of your habitual residence or place of work of an alleged infringement of the GDPR, the UK GDPR or the FADP.

We do periodical assessments of our data processing and privacy practices, to make sure that we comply with this Privacy Policy, to update the Privacy Policy when needed, and to verify that the Privacy Policy is displayed properly and accessible.
We will look into your query and make good-faith efforts to resolve any existing or potential dispute with you. Note that when you send us a request to exercise your rights, we will need to reasonably authenticate your identity and location. We will ask you to provide us credentials to make sure that you are who you claim to be and will further ask you questions to understand the nature and scope of your request.

Where we process Personal Information as part of our services, as a data processor of our customers (and not a data controller), we are committed to assist our data controllers in fulfilling the above mentioned rights under the GDPR, the UK GDPR or the FADP

Privacy Policy Updates

This Privacy Policy is subject to occasional revision, and if we make any substantial changes in the way we use or disclose information submitted by you, we will post a notice on this page.
